Kings Gate Subdivision Rules and Regulations

ALTERATIONS AND ADDITIONS. No material alteration, addition, or modification to a Homesite or the improvements thereon, or material change in the appearance thereof, shall be made without the prior written approval being first obtained as required by the Declaration.

EXTERIOR APPEARANCE.

  1. Except as expressly allowed by law, no sign is to exceed (including brokerage or for sale/lease 8.5" x 11") a flag, banner, sculpture, mailbox, fountain, solar equipment, artificial vegetation, sports equipment, advertisement, notice or other lettering shall be exhibited, displayed, inscribed painted or affixed in, or upon any part of a Homesite that is visible from the outside without the prior written approval of the ACC.
  2. Roofs and/or exterior surfaces and/or pavement including, but not limited to, walks and drives shall be pressure treated within thirty (30) days of notice by the ACC.
  3. Homes and structures shall be repainted within forty-five (45) days of notice by the ACC.
  4. Installation of any hurricane or other protective devices, such as hurricane panels, roll downs, and protective screens, visible from the outside of the Homesite shall be subject to the prior written approval of the ACC (including the color of the panels) and meet State of Florida, Charlotte County Building Code approval. Prior written consent is not required when the National Weather Service has indicated that there is an imminent threat of a hurricane affecting the Properties. In such instances, temporary unapproved hurricane shutters and protective devices may be installed, but must be immediately removed when there is no longer a hurricane threat. Owners who will be absent from their Homesite during Hurricane Season may choose to leave approved hurricane shutters in place until the official Hurricane Season is no longer in effect (June 1st through November 30th). If an owner will be absent from their Homesite and has arranged for a third party to install temporary unapproved hurricane shutters and protective devices in their absence, said owner and third party will be responsible for their removal when there is no longer an imminent threat of a hurricane.
  5. Window Air Conditioning Window and wall air conditioning units must obtain the prior written approval of the ACC. No window or wall air conditioning units shall be permitted unless flush with the Home exterior and screened by approved landscaping, if lower than six (6) feet from ground level. No window and air conditioning unit shall be placed at the front of any Home.
  1. No exterior visible antennae, aerials, or other similar equipment shall be placed on any Homesite, and no satellite dish may be placed on any Homesite without the prior written approval of the ACC or as provided by law.
  2. No owner shall operate any equipment or device which will interfere with the radio or television reception of others.
  3. No above-ground pools are permitted.
  4. All pools and appurtenances installed shall require prior written approval of the ACC.
  5. Except for seasonal holiday lights, all exterior lighting shall require written approval as outlined in the Declaration.
  6. No identical color schemes may be side by side.

ANIMALS and WILDLIFE. No animals other than domestic pets (specifically dogs and cats) shall be raised, bred, or kept within the properties. A maximum of two (2) dogs per property or as exceptions with HOA Board of Directors approval. No dog runs or enclosures will be permitted on any Homesite. No pet shall be permitted to run free. Pets on "tie-outs" must be supervised by the owner or designated person. Dogs will be leashed while walking, and the owner or designated person will be responsible for cleaning up solid material deposited on both grassy and pavement areas. Pets that are creating a nuisance must be controlled by their owners. Irresponsible pet owners will be held accountable for actions on a case-by-case basis. Cruel or unusual treatment of any type of animal may

PROTECTION. In the event a Home will be unoccupied for an extended period, the Home must be prepared prior to departure by (1) notifying the Association, (2) removing all removable furniture, plants, and other objects from outside the Home; and (3) designating a responsible firm or individual to care for the Home, should the Home suffer damage or require attention, and providing a key to that firm or individual. The name of the designee shall be furnished to the Association. Such a firm or individual shall contact the Association for permission to install or remove approved shutters or enclosures. The Association shall have no responsibility of any nature relating to any unoccupied Homesite.

Kings Gate Club Rules and Regulations

BYOB is not permitted in or on the Facilities. Any requests for a specific exception to this policy must be presented in writing to the Club Manager and/or Lifestyle Director for consideration. Alcoholic beverages will not be served or sold nor permitted to be consumed at or in the Facilities during hours or at locations prohibited by law. No alcoholic beverages will be sold or served to any person not permitted to purchase the same under the laws of the State of Florida and all ordinances or regulations as established by Charlotte County. Children under the legal drinking age are not permitted in any area where liquor is being sold unless accompanied by an adult.

All residents and their guests will dress in a fashion that befits the surroundings and atmosphere provided at the facilities. Residents will advise guests of the dress requirements. Neither muscle shirts nor bathing suits are permitted inside the Facilities. Shirts and shoes must always be worn when in the Facilities.

Within the facilities, metal spiked golf shoes of any kind or bare feet are permitted. When traveling to and from the pool, the Owner's tenant's guests and invitees are required to wear bathing suit cover-ups. The dress code is mandatory. Failure to comply may cause the person to be asked to change and may result in refusal of admission. Dress requirements may be published from time to time by the Club Manager.

Swimming, wading, and boating in the lakes on the premises are not permitted. Fishing is permitted at your own risk, except no fishing from the fairway side of lakes. Entering the water of the lakes on the premises to retrieve golf balls, other than by the Club Manager or the employees, is not permitted.

Bicycling, walking, and jogging on the golf course and cart paths are not permitted at any time.

Kings Gate Subdivision Rules and Regulations

(Single Family Homes)

LEASES. Homesites may be leased, licensed, or occupied only in their entirety, and no fraction or portion may be rented. No transient tenants may be accommodated at a home site. All leases or occupancy agreements shall be in writing, and a copy thereof shall be provided to the Association. No Homesite may be subject to more than three (3) leases in any twelve (12) month period, regardless of the lease term. The minimum lease term shall be one (1) month. No time-share or other similar arrangement is permitted. The Owner must make copies of the Declaration and related documents available to the lessee or occupants.

MAINTENANCE. No weeds, underbrush, or other unsightly growth shall be permitted to be grown or remain upon any Homesite. No refuse or unsightly object shall be allowed to be placed or suffered to remain upon any Homesite. All lawns, landscaping sprinkler systems, and any property, structures, improvements, and appurtenances shall be well maintained and kept in first-class, good, safe, clean, neat, and attractive condition. If an Owner fails to comply with these maintenance requirements after ten days' written notice, the Association, or its agent, may enter the Homesite and perform the required maintenance. The Owner shall be responsible for paying a fee pursuant to Paragraph 29 below plus actual costs incurred by the Association for materials, equipment, and labor in bringing the Homesite into compliance with the maintenance requirements above. This remedy of the Association shall be in addition to any other remedy provided in the Declaration.

SPECIAL USE FEES. The Association establishes the following special use fees which will be assessed against the Owner or designated occupant of the Homesite as appropriate:

  1. $100.00 fee for removal of large items of trash that are not collected as part of the normal garbage or waste removal service provided by the County. The Association, or its agent, will remove a large item of trash from a Homesite and assess this fee if a large item of trash remains on a Homesite, visible from the street or neighboring Homesites, for more than 14 days (after special pick-up has been arranged).
  1. $50.00. Fee for the replacement of a lost, damaged, or destroyed prospectus.
  2. $50.00 fee for all bounced/returned checks.
  3. $50.00 fee for replacement of any lost or damaged gate access device.
  4. $50.00 fee if the Association, or its agent, is required to perform the required maintenance on a Homesite in accordance with Number 6 above (Lawful Use).

PARKING. No overnight and or on-street parking shall be a hindrance to emergency vehicles. The parking facilities shall be used in accordance with the regulations adopted by the Association ... Owners, tenants, guests, invitees, and automobiles shall be parked in the garage or driveway. No vehicle which cannot operate on its own power shall remain on the Properties for more than twelve hours, except in the garage of a Home. No repairs, except emergency repairs, of vehicles shall be made within the Properties, except in the garage of a Home. No commercial vehicle, recreational vehicle, boat, or camper may be kept in the Properties except in the garage of a Home. The term commercial vehicle shall not be deemed to include recreational or utility vehicles (I.e., Broncos, Blazers, Explorers, etc.) up to 21'5" or clean "non-working" vehicles such as pick-up trucks, vans, or cars if they are used by the Owner on a daily basis for normal transportation.

SIGNS. Except as expressly allowed by law, no sign shall be permitted on or in a yard, sidewalk, or street right of way, but a "For Sale" sign no larger than 8.5" x 11" in a professionally permitted format may be placed in a window of a Home.

Kings Gate Covenants, Conditions and Restrictions - Villas

11.4 Leasing. Villas may be leased, with the minimum allowable lease period being thirty (30) consecutive days. No Villa may be rented or leased more than three (3) times in any twelve (12) month period. No lease may begin sooner than thirty (30) days after the first day of occupancy under the last previous lease. All leases are subject to the following restrictions and conditions:

  1. The lease must be written, and a fully executed copy must be provided to the Association not less than fifteen (15) days before the beginning of the lease term, together with such other information about the tenants as the Board may reasonably require.
  2. No lease may be for a period of less than thirty (30) consecutive days.
  3. No more than six (6) overnight occupants are allowed in a leased Villa.
  4. No subleasing or assignment of lease rights is allowed.
  5. No one but the lessee and the lessee's spouse, if any, and their unmarried children who live with their parents may occupy the unit during a lease.

All of the provisions of the Villas Documents and the Rules and Regulations of the Association pertaining to use and occupancy of the Villas shall be applicable to and enforceable against any person occupying a Villa as a lessee or guest, to the same extent as against an owner, and a covenant on the part of each occupant to abide by the rules and regulations of the Association and the provisions of the Villas Documents, designating the Association as the owner's agent, with authority to terminate any lease and evict the tenant in the event of violations by the tenant of such covenant, shall be deemed to be included in every lease whether oral or written, and whether specifically expressed in such lease or not.

7.4 Enforcement of Maintenance. If the owner of a Villa fails to maintain it as required above, the Association shall have the right to institute legal proceedings to enforce compliance or may take any and all other steps necessary to remedy such violation, including but not limited to entering the Lot, with or without consent of the owner.

The Association may repair, replace, or maintain any item which constitutes an immediate hazard to other property or residents or which has a material adverse effect on the appearance of the Neighborhood. Any expenses so incurred by the Association shall be assessed against the owner, together with reasonable attorney's fees and other enforcement expenses.

11.16 Parking. Owners' automobiles shall be parked in the garage or driveway. Each Villa will have a garage. Garage doors shall be kept in the closed position except when not in use for ingress and egress. No vehicle that cannot operate on its own power shall remain on Villas at Kings Gate for more than twelve hours, except in the garage of a Villa. No repairs, except emergency repairs, of vehicles shall be made within Villas at Kings Gate, except in the garage of a Villa. No commercial vehicle, recreational vehicle, boat, or trailer, including but not limited to boat trailers, house trailers, and trailers of every other type, kind, or description, or camper, may be kept within Villas at Kings Gate except in the garage of a Villa. The term "commercial vehicle" shall not be deemed to include recreational or utility vehicles (i.e., Suburbans, Blazers, Explorers, Navigators, etc.) up to 21'5" in length or clean "non-working" vehicles such as pick-up trucks, vans, or cars if they are used in the Oumer daily for normal transportation. Such vehicles shall not contain any commercial business names, written advertisements, or logos written on the outside of

11.7 Signs. In order to maintain an attractive community, no sign, banner, advertisement, or poster (including "open house," "for sale," or "for rent" signs) shall be exhibited, displayed, inscribed, painted, or affixed, in, on or upon any part of the Properties. This provision includes signs inside of Villa windows or the windows of motor vehicles. This Section 11.6 shall not apply to signs used by the Developer or its agents to market Villas owned by the Developer.

11.11 Fences. No fence, wall, hedge, or other physical and visual barrier shall be erected in the Neighborhood Common Areas except as originally installed by the Developer or as approved by the ACC.

Kings Gate Club Rules and Regulations

Swimming Pool

  1. Pool hours are from dawn to dusk.
  2. Use of a Pool is a swimmer's own risk. A lifeguard does not tend to the pool.
  3. Showers are required before entering the pool to remove suntan oils and lotions. This is a Health Department regulation.
  4. Residents in the pool area are not allowed to bring alcoholic beverages; only soft drinks and snacks are allowed.
  5. No drinks are permitted within 4 feet of the pool edge.
  6. No glass containers are permitted in the pool area.
  7. Swimmers must wear proper swim attire. Cut-off dungarees and Bermuda's are not considered appropriate swimwear.
  8. All incontinent individuals must wear swim diapers.
  9. No diving into the pool.
  10. No animals are allowed, with the exception of certified Service Animals.
  11. No running, horseplay, or unsafe behavior will be tolerated.
  12. All flotation devices, with the exception of noodles, are not permitted.
  1. Dispose of litter in proper receptacles.
  2. Bicycles, golf carts, rollerblades, etc., are not permitted in the pool area.
  3. Public intoxication will not be tolerated.
  4. Use of the pool is restricted to residents and their guests.
  5. Radios may be used only at very low volumes or with personal earphones.
  6. Saving of chairs for persons in the pool area is not allowed.
  7. All umbrellas must be closed upon leaving the pool area or at the conclusion of use.
  8. The pool area cannot be reserved for the exclusive use of individuals or for groups of residents or members.
  9. The club is not responsible for lost or stolen items.
  10. Report all accidents and injuries immediately.
  11. Pool pods should be picked up from the HOA Office for residents and their guests.

Spa

  1. Spa hours are from dawn to dusk.
  2. Shower before entering.
  3. No food, drink, glass, or animals in the spa or deck.
  4. Spa capacity 6 persons.
  5. The maximum water temperature shall be 104 degrees F.
  1. Pregnant women, people with health problems, and people using alcohol, narcotics, or other drugs that cause drowsiness should not use the spa without first consulting a doctor.
  2. No person under the age of twelve (12) is permitted in the spa.

Tennis and Pickleball (Need to Add Pickleball Info)

  1. The permitted hours of use are from dawn to 10:00 PM daily.
  2. Players are required to wear only soft court shoes and proper tennis clothing (shirts are required).
  3. Non-tennis shoes are not permitted anywhere on the courts.
  4. No food, chewing gum, or beverages in glass containers, as well as pets, skateboards, or bicycles, are allowed on the courts.
  5. Normal tennis etiquette and fair play are expected of all players.
  6. Court time must be registered on a sign-in book located in the Resident Center.
  1. Overnight house guests and visiting family members shall be entitled to reasonable use of tennis facilities.
  2. Residents may invite non-residents to play with them, provided that play shall be limited to one court at a time and one time per week. The resident host shall be a playing participant.
  3. Groom courts with mats and line brushes after playing and hang tools back on the fence.
  4. Please ensure that you take all litter off the courts when you have finished your game.

Shuffleboard

  1. The permitted hours of use are from dawn to 10:00 PM daily. Use is on a first-come basis.
  2. If all courts are in use, a time limit of ninety (90) minutes shall apply.
  3. Appropriate rubber-soled shoes are required on the courts.
  4. Equipment must be returned in good condition after play.

Bocce/ Lawn Bowling

  1. Bocce play is permitted between the hours of dawn and 10:00 PM.
  2. Appropriate etiquette and fair play are expected of all players.
  3. Players are required to wear smooth-soled shoes.

Fitness Center

  1. Limit your time on machines to 20–30 minutes when others are waiting
  2. Return and rack weights when you are finished using them.
  3. Pick up personal effects (i.e., towels, water bottles, magazines, etc.).
  4. No food or beverages (except water in plastic bottles) in the Fitness Center.
  5. Wipe down equipment when the exercise is completed.
  6. Wear appropriate attire (no cutoffs, sandals, or bare feet).
  7. Equipment is not to be removed from the Fitness Center.
  1. The club takes no responsibility for the loss of any personal items.
  2. The club is not responsible for any injury which may result from the use of any equipment.
  3. If you are unsure how to use a machine, seek assistance by contacting the Lifestyle Director.
  4. Do not attempt to use, move, or fix a piece of equipment that is not functioning properly. Report
  5. Non-functioning equipment to the Club manager.
  6. No one under the age of 18 is permitted to utilize the equipment.

Computer Room

  1. The computers may only be utilized by a resident.
  2. Internet access is available. However, reviewing or downloading pornographic material is not permitted.
  3. All equipment malfunctions, including computer and printer, should be reported to the Club Manager.
  4. Limit your time on the computer to 20–30 minutes when others are waiting.
